1) Upon you ("the Client") registering your vacancy with
Kangananny ("the Agency") the following terms
apply. These terms represent a legally binding contract between the Agency and
the Client.
2) The Agency will make every effort to source a suitable candidate to meet
your requirements. No fees are applicable until a Nanny has been placed with
you and employment has been confirmed.
3) Once the Agency begins your search for a qualified and/or
experienced nanny, you are under no obligation to employ any candidates
introduced by the Agency.
4) You have the right to withdraw your search without being
charged a fee by the Agency.
5) You have the right to change the job description whilst the
Agency undertakes the search for your Nanny.
6) You can vary or end the agreement either by telephone, email
or in writing.
7) The Agency will inform you immediately by telephone and
email if it can no longer provide a service to you.
8) Once the Client has selected a suitable Nanny, the Client
will inform the Agency immediately. Basic terms and conditions should be
discussed with your Nanny, including pay, hours of work, start date, travel
expenses etc. The Client should give the Nanny a formal written offer of
employment including these basic terms. We can advise on the negotiation of
these details and can act as a mediator between you and the Nanny if required.
9) A contract of employment will be drawn up to encompass the
offer letter and any other details you and the Nanny mutually agree on. Both
parties should sign the contract and the Agency will hold a copy on file.
10) It will be the responsibility of the Client to ensure that
any Tax and National Insurance contributions are deducted from the salary of
any employee introduced by the Agency, whether permanent or temporary and
employed by the Client. Nannies have the same legal responsibilities as other
childcare professionals and therefore require insurance.
11) The Agency fee is payable in full once a letter of
confirmation/invoice has been sent to the Client. If payment is not received on
the due date, a late payment surcharge of 10% per week will apply.
12) Should a temporary Nanny be offered a permanent position by
the Client, a permanent fee will be payable, less the Temporary Nanny fee
already paid.
13) If a Nanny fails to commence employment after a letter of
confirmation has been sent, the Agency will not charge the Client.
14) If a Client withdraws employment after a letter of
confirmation has been sent, the Agency fee will become payable immediately.
15) If employment proves unsatisfactory within the first 4
weeks, the Agency will make every effort to find a suitable replacement, free
of charge within 4 weeks, or refund the Client according to the Refund Policy.
Only one replacement can be made per permanent placement. Should the Client
decline to interview or to employ any Nannies put forward, it will be
considered that the Agency has properly and correctly discharged its
obligations and no further applicants will be submitted or a refund considered.
16) The replacement guarantee will not apply if the Client has
been in breach of the Agencies Terms of Business or if the Client
misrepresented the conditions of employment or if the fee payment has not been
made within fourteen days of commencement of employment. REFUND POLICY:

17) There will be no refund for a temporary assignment if the
Client makes other arrangements or cancels.
18) The Agency endeavours to verify the background of all
Nannies. Where possible, Nannies are interviewed by the Agency in their own
home, thoroughly reference checked and upon offer of employment, their status
checked against the Criminal Bureau Records. If at any time we haven't been
able to complete our vetting procedure due to time constraints, the Client will
be advised accordingly and will make the final decision.
19) The Agency cannot guarantee that all the information
regarding the applicant is accurate. The Agency does not accept liability
whatsoever for misrepresentation, loss, damage, claims or expenses incurred by
the Client. Whilst every care is taken by the Agency to check references
thoroughly, the Agency does not give any warranty concerning the history,
character, age, capability, health and suitability of any person introduced by
the Agency. Applicants are not employed by the Agency either directly or
indirectly and therefore the Agency cannot be held liable to the Client for any
loss, damage, or negligence of any person engaged by the Client.
20) Security checks are verified upon offer of employment. It
is recommended that a Nanny does not start work until the results are
confirmed. It is recommended that initially you employ your Nanny on a
probationary basis. The Agency accepts no responsibility for loss, damage or
negligence of any person engaged by the Client.
21) The final responsibility for accepting the applicant lies
with the Client.
22) The Agency advises candidates of their strictly NO SMOKING
POLICY within the Client home, the area surrounding the Clients home and
in the presence of children.
23) Each candidate is made aware of his or her position when taking up
employment in the Clients home. They must familiarise themselves with
procedures, health and safety and fire risk drills. They are expected to
perform all duties in a professional manner whilst caring for children in their
charge.
24) For the first 4 weeks of employment, the Agency will keep
in touch with the Client and the Nanny to ensure everything is still going
well. We can offer the service of a post commencement review to discuss on your
behalf with the nanny their progress and highlight any areas of improvement.
25) Should the Client contact, or be contacted by a prospective
employee by the suggestion of the Agency and at that stage decline to offer an
interview or employment but at some time within 240 days decide to employee
that person, whether it be the result of a personal advertisement, or other
means, it will be deemed that such employment is a direct result of an
introduction from the Agency and the full introduction fee will be due.
26) The Client shall take all reasonable precautions to ensure
the health and safety of any employee while on the Clients premises.
27) The Agency reserves the right to review the fees at any
time.
